Gift Card Shop Policy

General Terms of The Hotel Maria (SC Hotels Operations Oy) gift card shop.

These general terms of delivery apply to gift cards ordered through The Hotel Maria website, as well as gift cards purchased at the hotel. These general delivery terms apply to the contractual relationship between The Hotel Maria, the gift card purchaser and the gift card recipient. The gift card purchaser and recipient may also be the same person. The Hotel Maria reserves the right to cancel an order and terminate a transaction if the general terms and conditions of the agreement or specific service terms have been violated.

1. Special terms for each product

Product pages contain general as well as special conditions, and both are applicable. In case of a conflict between the general and special conditions, the special conditions would be given priority and enforced. It is crucial to read and understand the terms and conditions of a product before agreeing to them, as they may include significant information about your rights and obligations as a user. If you have any doubts or questions, it is advisable to contact the provider or seller to clarify any ambiguities before making a purchase and using the product.

2. Purchase Process

Gift cards are purchased through an online form, and later in 2023 through The Hotel Maria’s gift card shop. Kindly refer to section 13 (Payments).

Gift cards are sent to the buyer or receiver by the chosen delivery method, and The Hotel Maria sends the purchase confirmation via email. The prices displayed in The Hotel Maria gift card shop include applicable value-added tax. The delivery fee for gift cards varies depending on the delivery method, and is stated at the time of selecting method.

If the purchaser is under 18 years old, guardian’s consent is required. The Hotel Maria may verify the guardian’s consent via email or phone. When purchasing a gift card, the customer accepts the current general terms of delivery and special conditions. By using the gift card, the recipient accepts the general delivery terms and special conditions applicable at the time of purchase. The Hotel Maria provides the special conditions upon purchase.

3. Gift Card Content

The valid gift card is accepted as a payment for the mentioned product and by the service provider specified on the gift card. The service content is described in The Hotel Maria gift card shop. 4. Validity

The gift card’s validity is specified on the card. Unless otherwise stated in the special conditions, the gift card is valid for 12 months from the date of purchase. The product or service must be used during the gift card’s validity period.

5. Offers

Offers are valid only for the period specified. Offers cannot be combined with other offers unless otherwise stated.

6. Using the gift card

The gift card works as a payment method for the mentioned product by the service provider specified on the gift card. The gift card must be presented to the service provider at the time of payment. Most services sold by The Hotel Maria require advance booking. Gift cards cannot be refunded in cash nor can unused services be refunded.

7. Refund policy

The buyer of the gift card has the right to cancel the order within 14 days after receiving the card. However, the right of return does not apply if the gift card has already been used. The right of return also does not apply if the service date has been booked or the service provider has started preparations for providing the service. The buyer must return the gift card when cancelling the order.

The Hotel Maria will refund the buyer’s bank account within one month of receiving the cancellation. The refund is made to the bank account used for the original payment. For cash purchases, the refund will be made to the purchaser’s bank account.

8. Changes and redemption of the gift card

An unused gift card can be exchanged for another gift card during the validity period of the original gift card. In this case, the purchaser must return the original gift card when making the exchange. When exchanging for a gift card of lower value, The Hotel Maria will not refund the difference between the nominal values of the original and new gift cards. When exchanging for a gift card of higher value, the customer pays the difference between the cards.

The exchange of the gift card does not change the original validity period of the card, and thus the validity of the new gift card is determined by the purchase date of the original gift card. Unused gift cards will not be redeemed after the end of their validity period.

9. Limitation of liability

Gift cards sold by The Hotel Maria entitle the holder to use them as payment for the provided service specified on the gift card. The liability is always limited to the nominal value of the gift card. The Hotel Maria is not liable for damages or delays caused by force majeure (such as strikes, lockouts, payment embargoes and telecommunication disruptions).

11. Changes to the order and delivery terms

The Hotel Maria reserves the right to change its delivery terms. Before placing an order, it is the buyer’s responsibility to familiarize themselves with the currently valid order and delivery terms.

12. Applicable law and jurisdiction

These general delivery terms and the agreement between The Hotel Maria, the gift card purchaser and the gift card recipient are governed by the Finnish law. Any disputes arising from the contractual relationship shall be settled by the Helsinki District Court. Insofar as the Consumer Protection Act applies to the agreement, a consumer party to the agreement may also bring an action in their local district court.

13. Payments

Online gift card shop: Products and services are generally paid for at the time of ordering. In the online system, payment can be made via online banking or credit card. Payment is made through the service provided by Planet Payment Finland Oy (Mannerheiminaukio 1 A, 00100 Helsinki, Tel. +358 10 504 40 40, www.planetpayment.com).

If the payment is made by credit card, The Hotel Maria only acts as a marketer of products and services, and delivers the products and services to the buyer. As an exception, gift cards can be paid by advance invoicing. The Hotel Maria has the right to cancel a gift card order if the payment has not been received in full within 14 days from the order date in accordance with the general invoicing terms and conditions.
